La Jolla Apartments House Rules

Welcome to La Jolla Apartments. This is part of the housing contract and, therefore, should be read carefully. Questions regarding housing arrangements should be referred to the manager at 208.359.1985 or manager@lajollabyui.com
1. ROOM ASSIGNMENTS: The manager is responsible for all final rooming assignments and reserves the right to transfer or consolidate tenants at any time. The manager will make an effort to honor rooming requests when possible and when the request is made at least 30 days prior to the contract beginning. Tenants are expected to sleep in their own rooms.
2. UTILITIES: Your rent includes reasonable use of water, sewer, garbage, gas, electricity, etc. In the event the tenant or all tenants in a unit, are found to be wasteful in their utility use, the Landlord may impose additional charges.
3. OCCUPANCY: Apartments and rooms will not be ready for occupancy before the first day of the contract. Please do not expect to be checked in or out of the apartment before check in times or after check out times. Approval to stay before check-in or after check-out times must be obtained by manager and may incur a daily/nightly fee.
4. CHECK-IN AND CHECK-OUT PROCEDURES: Check-in and check-out procedures will be provided by your manager. Tenants must leave the apartment immediately after having officially checked out. Those who leave the apartment without checking out properly may be charged an amount up to equal of their deposit or $125. Early check-ins are not allowed unless per-approved by manager. A daily fee may be charged prior to the beginning contract date.
5. DAMAGES: Tenants are liable for any damages to the apartments. When more than one person is involved, each person will share in the expense. When tenants know who is responsible for any damage in public areas, they should furnish such information to the manager. The following are typical costs for replacement of the items indicated but the tenant may be charged the actual cost:

a. Carpet Repair (min charge/sq.yd.) $25+

b. Door Locks    $35-150

c. Key (lost)    $25

d. Light Fixture in kitchen    $250

e. Re-key a door    $75

f.    Windows (depending on size)

g. Door    $250

h. Garbage Disposals    $150

i. Light Fixture    $50

j. Mattress    $150

k. Screens    $30+

6. DECORATIONS: Appropriate decorations are encouraged. No items may be attached to the wall with nails or screws. Windows and ceilings should be free from decorations. All decorations must be in good taste and be promptly removed if requested by management.
7. FURNITURE: All apartments come fully furnished. No furniture may be removed from the room, apartment, or lounge to which it is assigned and no furniture may be added. THIS MEANS TENANT OWNED FURNATURE IS NOT ALLOWED.
8. DISCIPLINE: Tenants who violate university and/or apartment policies are subject to disciplinary sanctions which may include but are not limited to restrictions, fines, service, eviction, or other penalty as deemed by the Landlord or BYU-Idaho.
9. DISMISSAL FROM BYU-IDAHO: A student moving due to eviction or being asked to leave for disciplinary sanctions will be responsible for the remainder of their contract.
10.FIRE/SAFETY: All burning embers such as candles, incense, and open flames are prohibited. All outdoor walkways and stairs must always be free of garbage, bikes, furniture, etc… BBQ grills or like items may not be used anywhere on the property except for the one provided by the complex. A $400 fine may be assessed for tampering with fire extinguishers or alarms. Items are not to be hung from the fire sprinkler systems.
11.KEYS/SECURITY: Keys to apartments will be issued by the manager at Check-in. The Landlord is not responsible for any items lost, stolen or for any damage done. Keys may not be copied or duplicated. Tenants should ALWAYS lock the door to their apartments.
12.FIREARMS AND WEAPONS: Possession or use of firearms, weapons, and/or facsimiles on property owned or controlled by Landlord is strictly prohibited. For the purpose of this policy, firearms or weapons include any device which can expel a projectile, and/or other dangerous weapons, including knives, explosives, or other items which, in their intended use, are capable of inflicting serious injury.
13.GUESTS: No overnight guests of the opposite sex are permitted. All overnight guests (one or two days maximum) should have the permission of roommates and register with the manager. Immediate family members and other guest of the same sex may stay with a nominal charge per night. All guests are expected to abide by the BYU-Idaho standards and apartment rules & guidelines.
14.HOUSEKEEPING/CLEANING CHECKS: Tenants are required to maintain order and cleanliness in their living accommodations at all times. There will be regularly scheduled cleaning checks, EVERYONE is expected to participate. Tenants will supply their own cleaning products to clean their apartment/room. If housekeeping falls below the standard set by the manager, any necessary rechecks or cleaning may be done by the management approved person(s) and the tenant or tenants responsible may be charged fine and/or an hourly fee for the recheck and cleaning service.
15.MOLD: It is the tenant’s responsibility to keep their apartment clean and free of mold. If a reasonable effort has been made by the tenant to remove the mold and it is still there, tenant may submit a maintenance request for maintenance’s help in removing the mold. Landlord is not responsible for any mold damage to tenant’s personal property.
16.GARBAGE: All garbage must be placed in an appropriate garbage container and regularly disposed of. No garbage, waste, unsightly items, or other “trash” items may be placed or stored on sidewalks, porches, stairs, or in other common areas. Removal of garbage left in an apartment after move-outs will be charge to all tenants at the going rate.
17.WHITE GLOVE: Apartments are White Glove Clean at check-in and are expected to be White Glove Clean at check-out. If the apartment is not White Glove Clean at check-in, tenant is responsible for notifying management within 24 hours of check-in and management will correct it. Management will set the cleaning standards and requirements for White Glove Clean. When tenants check out of the apartments, their room/apartment must be White Glove Clean. The White Glove inspection is part of the checkout procedure. If checkout is not completed properly, part or all of the deposit could be used to cover itemized expenses. Damages beyond the deposit will be billed to the tenant.
18.PRIVACY: The Landlord supports a tenant’s right to privacy. The manager reserves the right to enter tenant’s rooms with the reasonable notice for maintenance, repairs, cleaning, inspection, and emergencies, to ensure compliance with the rules and regulations, and to show to prospective tenants.
19.LAUNDRY FACILITIES: Women have washing machines and dryers in each apartment. Men have use of the washing machines and dryers in the laundry room. The Landlord is not responsible for items damaged, destroyed, lost or stolen in our machines. Laundry machines are for tenant use only. The tenant will be fined $50 for allowing non-tenant use.
20.LINEN: Tenants are required to provide zippered mattress covers. They also need to bring their own sheets, pillows, pillow cases, blankets, bedspreads, towels, washcloths, etc…. All beds are standard twin size.
21.LITERATURE, BOOKS, MAGAZINES, POSTERS AND PICTURES: Please remember the environment of BYU-Idaho. We require all reading material, posters, or pictures be consistent with LDS standards.
22.TELEVISION & OTHER MEDIA: Landlord may provide cable TV. Management has the prerogative of changing the channel or turning off the TV if the program being viewed in the lounge is in poor taste. Internet access, music, television, or any form of entertainment, including concerts, movies, and videocassettes that are vulgar, immoral, inappropriate, suggestive, or pornographic in any way, no matter what the rating, violates the spirit of the BYU-Idaho Code of Honor and is not acceptable. R-rated viewing is inappropriate and good judgment should be exercised in selecting appropriate movies of other ratings.
23.INTERNET: Landlord may provide internet as a privilege, not a right. Management has a goal of providing the fastest, filtered, wired and wireless internet possible. Internet technologies are constantly changing and tenant’s needs are constantly changing as well. From time to time, it may be necessary to limit internet use or terminate wireless or wired access. Tenants may not install or use personal routers, switches, servers, etc… Please use the internet wisely and be considerate of your bandwidth use. The manager has sole discretion on all internet use and may fine for improper usage or terminate an individual or apartment use of the internet for any usage the manager deems unreasonable usage by the tenant or apartment.
24.TELEPHONES: The manager may provide, in the office, limited telephone service at no charge for local calls. Individual apartments do not have phone service.
25.MAIL SERVICE: One key to the apartment mail box will be provided in the apartment. As soon as possible after arrival at our complex, inform parents, friends, relatives, etc., of your correct address. The address is: (Your Name) 65 S 1st W Apt# __ Rexburg, ID 83440. Tenants are responsible for forwarding their mail at the end of their tenancy. Packages will be delivered to your apartment or may be brought to the office. The landlord is not responsible for lost or stolen packages.
26.MAINTENANCE: If a tenant notices anything in an apartment or room that requires repair work or maintenance attention, please notify the manager or maintenance by using the property internet portal or emailing the manager. DO NOT FLUSH ANYTHING DOWN THE TOILET OTHER THAN TOILET PAPER. Tenant is responsible for unclogging the toilet and must provide their’ own plunger. If a reasonable effort has been made to unclog the toilet and it is still clogged, tenant may submit a maintenance request.
27.MANDATORY MEETINGS: At the beginning of each semester mandatory meetings are held to explain apartment rules and regulations that are critical for the tenant to know. All tenants will be held accountable for any information discussed or distributed in the meeting. This addendum is not all inclusive, additional rules may be discussed.
28.PARKING: A tenant who wishes to park a car at the complex must sign a parking contract before they arrive. Upon arrival, tenants with a parking contract must pick up their permit from the manager. Parking is limited; there are not enough stalls for every tenant to bring a car. Offsite parking is available. Rexburg City ordinance does not allow overnight parking on City streets during winter months. Cars without a valid semester permit properly displayed will be booted or towed. Repairing cars on the property is prohibited. Visitors may park during the day in the marked “Visitor” stalls, a visitor pass may be obtained from the office for limited overnight parking. Motorcycles, scooters, etc… must park in a designed parking stall with a valid parking pass and may not be parked anywhere else on the property.
29.BICYCLES: Tenants may not store bicycles in the apartments, stairwells, or corridors at any time. Outside bicycle racks are available. Landlord will not be responsible for loss or damage to any tenants bicycle. Tenant must get a bicycle permit from the manager. Bicycles found on property without a permit will be removed and donated to charity. Tenant is responsible for removing bicycle when checking-out. Tenants must move their bicycles to one rack, designated by management, and only use that rack from December to March of each year. Bicycles that are attached to any other rack during those months, will be removed and donated to charity. Bicycles that are not used regularly will be considered abandoned.
30.PETS: Pets of any kind are not allowed on the property. 31.PROHIBITIONS: Dart boards, Ouija boards, fireworks of any kind, explosives, illicit drugs,
alcohol, gambling, open flames (or use of matches, candles, incense, etc.), pets or animals, and vulgarity or any rude and unusual disturbance are not consistent with BYU-Idaho standards and are prohibited.
32.QUIET HOURS: Quiet hours are from 10 p.m. until 8:30 a.m. Monday through Saturday and all day on Sunday. Quiet hours are designed to help tenants have adequate time for proper study and sleep. Each tenant is expected to refrain from disturbing activities such as loud conversation and laughter or loud playing of radios, stereos, etc. Tenants do not have the right at any time to be so excessively loud that it is unfair disturbance to other residents.
33.STORAGE: Storage may be available to the tenants, please check with the manager. If storage is available, it is group storage with access to all residents. Landlord is not responsible for lost, stolen, or damaged personal items. TENANTS STORE AT THEIR OWN RISK. Items left anywhere on the property will be considered abandoned and will be disposed of. Repair or storage of automobiles, bicycles, motorcycle parts, or similar mechanical devices is not permitted in the apartment or room. Managers cannot mail personal belongings. It is the tenant’s responsibility to see to it that all personal belongings are sent to where the tenant wishes them to go. Tenant will be charged $50 per bag for removal of personal items.
34.WATER FIGHTS: Water fights are prohibited. Any disruptive behavior using damaging products is strictly prohibited.
35.WINDOWS: Windows are operable and tenants must use good judgment when to open and close them. Screens must not be removed, tenants will be fined for removing them. Tenant will be responsible for weather damage if windows are left open in inclement weather. Tenants need to consider utility usage when opening windows in winter. ALL TENANTS MAY BE CHARGED FOR EXCESSIVE UTILITY USAGE IF WINDOWS ARE LEFT OPEN IN WINTER.
36.COMMON AREAS/AMMENITIES: Areas at the complex designated as “Common Areas” or “AMMENITIES” will be discussed at the mandatory meeting. Their usage is a privilege and not a right. Some areas are available by reservation for exclusive temporary use. Tenant must not store any personal property in these areas and items found in these areas will be disposed of. Tenants must clean up after themselves and leave the areas in better condition after their use.
37.CLEAN, SAFE, FUN: Management will provide a clean, safe, fun environment for all tenants. We want to provide you with the very best housing experience possible. If we can be of service in anyway, please let us know and we’ll do our best to accommodate you.
